The creation of the Institute of Lokpal similar to that of the ombudsman was recommended by the interim report of the Administrative Reform Commission.
The institution of Lokayukta in States -
In India, the number of States has adopted ombudsman Systems by enacting Lokayukta Laws. State of Maharashtra has passed A statute of Maharashtra Lokayukta and UP Lokayukta Act 1971. The functions of Lokayukta will be confined only to all allegations relating to actions taken by a Minister or a secretary of State Government, excluding those of chief ministers.
Main features of the Lokpal and Lokayukta -
According to the Administrative Reforms Commission, the Lokpal and Lokayukta should have the following features.
1) Lokayukta and Lokpal should be independent and impartial.
2) The investigation and proceedings of Lokpal and Lokayukta should be conducted in private and should be informal in character.
3) Appointment of Lokpal and Lokayukta should be Non-political.
4) Status of Lokpal and Lokayukta should be compared with the highest judicial functionary in the country.
5) Their proceeding should not be subject to judicial interference and they should have the maximum latitude and powers in obtaining information relevant to their duties.
6) Lokpal and Lokayukta should deal with matters in the discretionary field involving acts of injustice, corruption or favoritism.
7) Lokpal and Lokayukta should not look forward to any benefit or pecuniary advantage from the executive government.
8) The person appointed as Lokpal must not be connected with any political party, must not be a member of Parliament or state legislature or Hold any office of profit
